Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the KimMart Rewards or KimMart Staff mobile applications ("Apps"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and Kim Mart Supermarket ("Kim Mart," "we," "us," or "our").

If you do not agree to these Terms, you must not download, install, or use our Apps.

These Terms apply to:

• KimMart Rewards - Customer loyalty rewards application
• KimMart Staff - Internal staff management application

2. Our Services

2.1 KimMart Rewards (Customer App)

The KimMart Rewards app provides customers with:

• Digital loyalty card and QR code for in-store scanning
• Points tracking and transaction history
• Reward catalog browsing and redemption
• Account management and profile settings
• Push notifications for promotions and account activity

2.2 KimMart Staff (Staff App)

The KimMart Staff app is an internal tool for authorized employees providing:

• Customer lookup and points management
• Transaction processing (points awarding and redemption)
• Store statistics and analytics
• Staff communication tools

Note: Access to KimMart Staff is restricted to authorized Kim Mart employees only. Unauthorized access is prohibited.

3. Eligibility

3.1 Age Requirements

You must be at least 13 years old to use our Apps. If you are under 18, you must have parental or guardian consent to use our services.

3.2 Geographic Availability

Our services are primarily intended for use in Belize. Some features may not be available in all locations.

3.3 Staff App Access

The KimMart Staff app is exclusively for current Kim Mart employees. Access credentials are provided by store management and remain the property of Kim Mart.

4. User Accounts

4.1 Account Creation

• Customer accounts: Created through the KimMart Rewards app using a valid email address
• Staff accounts: Created by Kim Mart administrators only

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Using strong, unique passwords

4.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.

4.4 One Account Policy

Each customer is entitled to one loyalty account. Creating multiple accounts to exploit promotions or accumulate additional points is prohibited and may result in account termination.

5. Loyalty Program Rules

5.1 Earning Points

• Points are earned on qualifying purchases at Kim Mart stores
• Point rates vary by membership tier (Regular, VIP, SVIP)
• Points are credited after transaction completion
• Points cannot be earned on certain items (alcohol, tobacco, gift cards, etc.)

5.2 Membership Tiers

Our loyalty program includes three membership tiers:

• Regular: Base membership for all customers
• VIP: Achieved by meeting monthly spending thresholds
• SVIP: Premium tier with enhanced benefits

Tier status is evaluated based on monthly spending and may change based on your purchase activity.

5.3 Redeeming Rewards

• Rewards can be redeemed using accumulated points
• Reward availability is subject to stock and program terms
• Points required for rewards may change without notice
• Redeemed rewards cannot be returned for points

5.4 Points Expiration

Points may expire after extended periods of account inactivity. We will notify you before points expire. Check your account regularly to monitor your point balance.

5.5 Program Modifications

Kim Mart reserves the right to modify, suspend, or terminate the loyalty program or any aspect thereof at any time. We will provide reasonable notice of significant changes.

6. Acceptable Use

You agree not to:

• Use the Apps for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Apps
• Interfere with or disrupt the Apps or servers
• Transmit viruses, malware, or other harmful code
• Engage in fraudulent activity or misrepresent your identity
• Create multiple accounts to exploit promotions
• Share, sell, or transfer your account or points
• Use automated tools to interact with the Apps
• Reverse engineer or attempt to extract source code
• Remove or alter any proprietary notices

7. Intellectual Property

7.1 Ownership

The Apps and all content, features, and functionality (including but not limited to design, text, graphics, logos, icons, images, and software) are owned by Kim Mart and are protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Apps for personal, non-commercial purposes in accordance with these Terms.

7.3 Restrictions

You may not:

• Copy, modify, or distribute the Apps
• Use the Apps for commercial purposes without authorization
• Create derivative works based on the Apps
• Use Kim Mart's trademarks without permission

8. Disclaimers

THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Apps will be uninterrupted or error-free
• Defects will be corrected
• The Apps are free of viruses or other harmful components
• The results of using the Apps will meet your requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIM MART SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APPS.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO KIM MART IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

10. Termination

10.1 Termination by You

You may stop using the Apps at any time. Customer accounts may be deleted upon request by contacting our support team.

10.2 Termination by Us

We may suspend or terminate your access to the Apps at any time, with or without cause, including for:

• Violation of these Terms
• Fraudulent or illegal activity
• Account inactivity
• At our discretion for any reason

10.3 Effect of Termination

Upon termination, your right to use the Apps will immediately cease. Any accrued points may be forfeited. Sections of these Terms that by their nature should survive termination will survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belize, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Apps shall be resolved in the courts of Belize City, Belize, and you consent to the personal jurisdiction of such courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms in the Apps
• Updating the "Last Updated" date
• Sending a notification through the Apps (for significant changes)

Your continued use of the Apps after changes become effective constitutes your acceptance of the revised Terms.
